By accessing and using Sierra Single Track ("the Service"), including our website (sierrasingletrack.com) and mobile application, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Sierra Single Track LLC. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

Sierra Single Track provides GPS tracking, trail mapping, and outdoor activity logging services for off-road enthusiasts, including but not limited to:

  • GPS track recording and storage
  • Photo and video upload capabilities
  • Live location sharing with friends and family
  • Gear and equipment management
  • Maintenance tracking and reminders
  • Trail discovery and community features
  • Statistics and analytics for your activities

3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You must be at least 13 years of age to use this Service. If you are under 18, you must have parental consent.

4. Subscription Plans and Payments

4.1 Subscription Tiers

Sierra Single Track offers multiple subscription tiers:

  • Basic (Free): Limited features including basic GPS tracking and limited uploads
  • Pro: Enhanced features including unlimited uploads, live tracking, and advanced analytics
  • Expedition: Premium features including all Pro features plus priority support and exclusive content

4.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually) unless cancelled. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

5. User Content

5.1 Your Content

You retain ownership of all content you upload, including GPS tracks, photos, videos, and comments ("User Content"). By uploading content, you grant Sierra Single Track a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing the Service.

5.2 Content Standards

You agree not to upload content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Is sexually explicit or pornographic
  • Promotes violence or discrimination
  • Infringes on intellectual property rights
  • Contains malware or viruses
  • Violates any person's privacy rights

5.3 Content Moderation

We reserve the right to remove any content that violates these Terms or that we find objectionable for any reason, without prior notice. We use automated systems including AI-based content filtering to detect and remove inappropriate content.

6. GPS and Location Services

6.1 Location Data

The Service collects GPS and location data to provide tracking features. By using these features, you consent to the collection and processing of your location data as described in our Privacy Policy.

6.2 Accuracy Disclaimer

GPS data may be inaccurate due to various factors including device limitations, atmospheric conditions, and geographic features. You should not rely solely on our Service for navigation, safety, or emergency purposes.

6.3 Live Tracking

When you enable live tracking, your real-time location may be visible to others via a shared link. You are responsible for managing who has access to your live tracking links.

7. Safety and Liability

7.1 Outdoor Activity Risks

Off-road activities including dirt biking, ATV riding, hiking, and mountain biking are inherently dangerous. By using this Service, you acknowledge that:

  • These activities carry risk of serious injury or death
  • Trail conditions may change without notice
  • You are responsible for your own safety and decisions
  • You should always wear appropriate safety gear
  • You should inform others of your planned route

7.2 No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIERRA SINGLE TRACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE.

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to the website design, logos, graphics, and software, are owned by Sierra Single Track and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without prior written consent.

Our Service may integrate with or link to third-party services, including:

  • Payment processors (Stripe, Apple Pay, Google Pay)
  • Map providers (MapTiler, OpenStreetMap)
  • Authentication providers (Apple Sign-In, Google Sign-In)
  • Cloud storage providers

Your use of these services is subject to their respective terms and conditions. We are not responsible for the content, privacy policies, or practices of third-party services.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Harmful conduct toward other users
  • Extended period of inactivity

Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
